{"id":64321,"date":"2010-08-12T19:11:27","date_gmt":"2010-08-13T00:11:27","guid":{"rendered":"https:\/\/latamjournalismreview.org\/?p=64321"},"modified":"2022-08-09T19:13:25","modified_gmt":"2022-08-10T00:13:25","slug":"uruguay-define-el-reglamento-de-la-ley-de-acceso-a-la-informacion","status":"publish","type":"post","link":"https:\/\/latamjournalismreview.org\/es\/articles\/uruguay-define-el-reglamento-de-la-ley-de-acceso-a-la-informacion\/","title":{"rendered":"Uruguay define el reglamento de la ley de acceso a la informaci\u00f3n"},"content":{"rendered":"<p><em>Por Maira Magro<\/em><\/p>\n<p>Casi dos a\u00f1os despu\u00e9s de la promulgaci\u00f3n de la Ley de Acceso a la Informaci\u00f3n P\u00fablica (o\u00a0<a href=\"http:\/\/200.40.229.134\/leyes\/AccesoTextoLey.asp?Ley=18381&amp;Anchor\">Ley 18.381<\/a>) en Uruguay, el Ejecutivo public\u00f3 un\u00a0<a href=\"http:\/\/www.cainfo.org.uy\/images\/Documentos\/Legislacion\/decreto_reglamentario_leyuy.pdf\">decreto<\/a>\u00a0que reglamenta su aplicaci\u00f3n y uso. Con el fin de incentivar a los periodistas de todo el pa\u00eds a usar esta herramienta legal, el Centro de Archivos y Acceso a la Informaci\u00f3n P\u00fablica (CAInfo) lanz\u00f3 esta semana la campa\u00f1a\u00a0<a href=\"http:\/\/www.cainfo.org.uy\/noticias\/3-general\/92-cainfo-lanza-campana-de-difusion-de-la-ley-de-derecho-de-acceso-a-la-informacion-publica-dirigida-a-periodistas-de-todo-el-pais\">\u201cHaz tu propio pedido\u201d<\/a>.<\/p>\n<p>Seg\u00fan el decreto, cada vez que las instituciones p\u00fablicas consideren una informaci\u00f3n como \u201creservada\u201d deber\u00e1n explicar la decisi\u00f3n a trav\u00e9s de una resoluci\u00f3n fundada, a\u00f1ade\u00a0<a href=\"http:\/\/www.elpais.com.uy\/100804\/pnacio-506117\/politica\/reglamentan-ley-de-acceso-a-informacion\">El Pa\u00eds<\/a>. Tal resoluci\u00f3n tendr\u00e1 \u201celementos objetivos que permitan determinar la expectativa razonable\u201d de que la divulgaci\u00f3n de la informaci\u00f3n acarrear\u00eda \u201cda\u00f1os al inter\u00e9s p\u00fablico protegido\u201d. La Unidad de Acceso a la Informaci\u00f3n P\u00fablica \u2014el organismo garante de la ley\u2014 podr\u00e1 desclasificar las informaciones si considera que la reserva de los datos no se justifica.<\/p>\n<p>El decreto tambi\u00e9n determina que los organismos p\u00fablicos deber\u00e1n designar a al menos un funcionario a cargo de las solicitudes de acceso a informaciones, explica El Pa\u00eds.
