"The Second Court of Appeals has annulled, for the second time, the 2023 conviction of journalist José Rubén Zamora and ordered a new trial before the Ninth Criminal Sentencing Tribunal. The resolution complies with an October 2025 order by the Criminal Chamber of the Supreme Court of Justice (CSJ), which had returned the case file for the appeals court to issue a new ruling correcting deficiencies identified in its previous decision.
With this decision, the court once again recognized that the prosecution could not stand under the conditions in which it was conducted. The case was marked by criticism regarding the violation of the journalist's rights, who during trial reported being denied bail and prevented from presenting exculpatory evidence for an effective defense.
Although the court rejected one of the arguments regarding the exclusion of evidence on procedural grounds, it concluded that there were flaws in the legal reasoning of the sentence that necessitated its annulment, requiring a new trial."
