"The Court of Appeals of Santiago rejected a constitutional protection lawsuit filed by a former corporate manager against La Izquierda Diario, the National Federation of Holding Heineken CCU Workers' Unions, and Google Chile, which requested the removal and de-indexing of news publications concerning a labor complaint filed years earlier. The court concluded that, in weighing the freedom of information against the right to be forgotten, the former must prevail, as the contested news reports informed on truthful facts of public interest.
The lawsuit argued that various publications disseminated by La Izquierda Diario and by the National Federation of Holding Heineken CCU Workers' Unions remained available on the internet and appeared prominently in Google search results, despite the fact that the judicial proceeding to which they referred had concluded through a settlement approved by the competent court."
