"Prosecutor Katia Atencio refused to impose precautionary measures to prevent the newspaper La Prensa and its associate deputy director, Rolando Rodríguez, from investigating and reporting on the business activities of Vicente Carretero Napolitano.
Atencio noted that Rodríguez's articles contain no elements constituting intimidation, harassment, retaliation, or pressure against Carretero. She further observed that the news reports do not even mention him, as they refer to ‘a different person’ — his brother Ramón.
The precautionary measures were requested by Marcela Araúz, Carretero's attorney, within a criminal complaint against Rodríguez and Corporación La Prensa, S.A. (Corprensa) for alleged slander and libel.
The prosecutor argued that protective measures cannot become an instrument to restrict fundamental rights that lack a direct, necessary, and proportional relationship to the risk situation they seek to prevent."
