“The Santiago Court of Appeals in Chile rejected a protection appeal filed against Google Chile and other communications companies for keeping online news articles about a criminal conviction served more than 17 years ago.
The petitioner argued the continued online availability of news about a conviction completed over 17 years ago violated her honor and privacy, as the case had been legally resolved through the full serving of her sentence and the deletion of her criminal record.
She invoked the so-called ‘right to be forgotten,’ asking that the media outlets and the search engine be ordered to remove or de-index links connecting her to events already resolved, in defense of the rights guaranteed under Articles 19.4 and 19.24 of the Constitution.
Compañía Chilena de Comunicaciones argued the contested publications were accurate news reports published under the legitimate exercise of freedom of expression and the right to inform, both protected under Article 19.12 of the Constitution.”
