Adverse ruling against the State of Guatemala for violating rights of community radio stations

The Inter-American Court of Human Rights (I/A Court HR) published a ruling dated Oct. 6, 2021 in the case of the Maya Kaqchikel Indigenous Peoples of Sumpango et al v. Guatemala. The Inter-American Court found the State of Guatemala responsible for violating the rights to freedom of expression, equality before the law, and the right to participate in cultural life.

In summary, the facts concern the lack of legislation on community radio. The General Telecommunications Law (LGT, by its Spanish acronym) established a novel process to grant the use of the radio-electric spectrum through Titles of Usufruct (TUF) that are assigned through an auction system.

However, this mechanism is not suitable for community radio stations that do not have the means to access this resource through an auction.
