Peru's Judiciary ratifies acquittal of OjoPúblico's director in defamation lawsuit

"The Judiciary permanently shelved the last defamation complaint filed by the Peruvian American citizen Miguel Arévalo Ramírez, known as 'Eteco,' in the files of the Anti-Drug Police and the Prosecutor's Office, against Óscar Castilla, executive director of OjoPúblico.  In 2016, Castilla published an investigative journalistic series about Arévalo's judicial history.

Since 2017, Arévalo filed a series of lawsuits against Castilla and OjoPúblico in four criminal courts in Lima. […] Recently, the Tenth Liquidating Criminal Chamber of Lima announced the shelving of the last case from the 15th Criminal Court of Lima. The ruling highlights three key aspects to rejecting the lawsuit filed by Arévalo Ramírez for the OjoPúblico publications in 2016: the constitutional exercise of reporting as an investigative journalist and media outlet, res judicata (that is, a person cannot be prosecuted for the same facts and when there is already a previous acquittal), and the status of limitations for criminal proceedings."
