Guatemala’s Constitutional Court ruled by majority to overturn a temporary injunction that had been granted by the Supreme Court’s Injunction Chamber in favor of journalist José Rubén Zamora.
Although the injunction did not order Zamora’s release, it allowed his case to return to the Third Court of Appeals for a new review of a legal challenge against the decision to revoke substitute measures that had been granted in his second trial.
The challenge reviewed by the Constitutional Court was filed by the Special Prosecutor’s Office Against Impunity (FECI), which opposed the provisional protection that had been granted to Zamora and the referral of the case back to the appeals court. The ruling effectively validates the procedure that has kept Zamora in prison.
