Top Colombian court finds prosecutors violated rights of journalists in spying probe

“In Ruling T-084 of 2026, Colombia's Constitutional Court concluded the Seventh Prosecutor’s Office delegated to the Supreme Court violated the rights to due process, access to justice, and access to information of Andrea Aldana, Óscar Parra, and the media outlet Rutas de Conflicto by refusing to recognize them as victims in the criminal investigation into the profiling of various media outlets and journalists. The Foundation for Press Freedom welcomed the decision, saying it represents progress in the search for justice and in clarifying the profiling these journalists and outlet were subjected to between 2019 and 2020.

Six years after an illegal surveillance network operated out of the Cyber Intelligence Battalion in Facatativá was revealed—and after Semana published the investigations “Chuzadas sin Cuartel” and “Las Carpetas Secretas,” exposing the use of malware and tactical tools to profile journalists, politicians, judges, and human rights defenders—the Constitutional Court ruled in favor of the victims.”
